Peninsula Commercial will oversee and coordinate the design and construction of the project in accordance with owner’s instructions.

On behalf of owner, Peninsula’s agents will engage, retain, contract with, supervise, coordinate and discharge all persons reasonably required to design and construct the project, including without limitation intended, attorneys, architects, engineers, surveyors, general contractors, construction managers, subdevelopers, subcontractors and material men.

We will enter into construction contracts on the basis of time, labor and material, a stipulated amount, or a guaranteed maximum cost whichever basis is more appropriate, first providing owner fifteen (15) days prior written notice and a copy of all such contracts.

Peninsula Commercial will procure or cause to be procured on behalf of owner, all permits, approvals and other governmental authorizations required by law for the construction of the project.

We will make all reasonable efforts to cause the completion of the design and construction of the project in a reasonable manner.

We will make all reasonable efforts to cause the design and construction of the project to be performed in a good, workman-like manner, and in accordance with all applicable law and other governmental requirements.

Our agents will prepare and amend from time to time, a schedule for the development of the project which shall include with respect to the building and related improvements; reasonable dates for the completion of approved plans and specifications, procurement of construction financing, procurement of building permits and the commencement, substantial completion and completion of construction.

Our agents will prepare and maintain, in accordance with generally accepted accounting principles consistently applied, cash receipts and disbursement books and records, reflecting all money received and all money disbursed by the developer in connection with the project.

Within ninety (90) days after each calendar year during the term of the development project, we will deliver to the owner a summary setting forth in reasonable detail all the money received and disbursed by the developer in connection with the project and a general status report on the development of the project.

Peninsula Commercial will make reasonable efforts to require each architect, general contractor and construction manager to maintain insurance coverage against such perils and with such limits as may be reasonably requested by the owner prior to the time that their respective services are contracted for.

We will insure that each general contractor maintains such payment and/or performance bonds in such amounts as may be reasonably requested by owner prior to the time that their respective services are contracted for.
